NOT INCLUDED IN THE FIRST HEARING BECAUSE OF A PROBLEM WITH PROPER <br />NOTICE. 14HEN IT DID COME UP FOR A PUBLIC HEARING BEFORE THE <br />PLANNING AND ZONING COMMISSION, MR. COTTON OPPOSED THE SUGGESTED <br />REZONING FROM C-lA To R -2C THROUGH HIS ATTORNEY, MICHAEL O'HAIRE, <br />AND THE ZONING BOARD DID NOT REZONE THE PROPERTY. .ATTORNEY COLLINS <br />CONTINUED THAT HIS MATTER IS ON OUR AGENDA TODAY BECAUSE IT HAS <br />BEEN ADVERTISED, BUT ACTUALLY A HEARING IS NOT NECESSARY, <br />ASSISTANT PLANNER BERG NOTED THAT THERE HAS BEEN NO FORMAL <br />APPEAL OF THE REZONING DENIAL, BUT HE FELT A MOTION SUSTAINING <br />THE ACTION OF THE ZONING BOARD WOULD BE IN ORDER. <br />ATTORNEY COLLINS DID NOT FEEL ANY FORMAL ACTION IS NECESSARY <br />BECAUSE THIS MATTER IS NOT OFFICIALLY OR FORMALLY BEFORE THE BOARD AT <br />THIS TIME. <br />ATTORNEY O'HAIRE STATED THAT SINCE.THIS MATTER HAS BEEN <br />ADVERTISED, HE WOULD LIKE TO HAVE A MOTION TO ACCEPT THE <br />RECOMMENDATION OF THE ZONING COMMISSION THAT THE REZONING BE DENIED, <br />AND ATTORNEY COLLINS STATED THAT HE DID NOT HAVE ANY PROBLEM WITH <br />THAT. <br />MOTION WAS MADE BY COMMISSIONER SIEBERT, SECONDED BY <br />COMMISSIONER Loy, TO ACCEPT THE RECOMMENDATION OF THE PLANNING AND <br />ZONING COMMISSION FOR DENIAL OF REZONING OF LOT 125, UNIT II, THE <br />MOORINGS SUBDIVISION, TO R -2C. <br />ASSISTANT PLANNER BERG RECOMMENDED THAT THE BOARD AT <br />LEAST HEAR THE PRESENTATION AND THEN MAKE THEIR OWN DETERMINATION. <br />ATTORNEY COLLINS STATED THAT SINCE THIS MATTER HAS NOT <br />BEEN APPEALED TO THE BOARD, HE DID NOT FEEL THIS WOULD BE <br />APPROPRIATE. <br />COMMISSIONER SIEBERT AGREED THAT WHOEVER INIATED.THE REQUEST <br />FOR THE ZONING CHANGE WOULD HAVE TO APPEAL IT TO THE BOARD.' <br />ASSISTANT PLANNER BERG POINTED OUT THAT THE PLANNING & <br />ZONING COMMISSION IS AN ADVISORY BOARD AND THE BOARD OF COUNTY <br />COMMISSIONERS IS THE FINAL AUTHORITY.
