ATTORNEY COLLINS ASKED THAT THE BOARD GIVE SOME CONSIDERATION <br />TO CHARGING A FRANCHISE FEE FOR CABLEVISION. HE FELT THE COUNTY HAS <br />AUTHORITY UNDER THEIR FRANCHISE WITH CABLEVISION TO CHARGE SUCH A <br />FEE, WHICH WOULD BE 3%. HE NOTED THIS .IS STANDARD.PRACTICE <br />THROUGHOUT THE COUNTRY. HE ASKED THAT THE BOARD INFORM HIM1 IF THEY <br />WISH TO GIVE THIS ANY CONSIDERATION.AND HE WILL PUT IT ON THE AGENDA <br />AS A FORMAL ITEM. <br />ATTORNEY COLLINS REPORTED THAT WE ARE JUST ABOUT READY TO <br />CLOSE ON THE PURCHASE OF URBAN DEVELOPMENT UTILITIES' ASSETS AND <br />STATED THAT HE HAS PREPARED A RESOLUTION. THE RESOLUTION, HOWEVER, <br />DOES NOT STATE THAT THE FUNDS WILL COME OUT OF REVENUE SHARING, AND <br />HE FELT THERE SHOULD BE A MOTION TO THAT AFFECT. HE NOTED THAT THE <br />RESOLUTION REFERS TO THE POSSIBILITY OF ENTERING INTO AN ESCROW <br />AGREEMENT, AND THIS IS BECAUSE OF A TITLE PROBLEM THAT HAS ARISEN. <br />ATTORNEY COLLINS CONTINUED THAT HE HAS DISCUSSED THIS WITH FHA, AND <br />THEY ARE AGREEABLE TO ESCROWING $45,000 PURSUANT TO THE TERMS OF THE <br />PROPOSED ESCROW AGREEMENT. HE NOTED THAT THERE WERE A FEW MINOR <br />CHANGES IN THE AGREEMENT WHICH, TO HIS MIND, DID NOT MAKE ANY MAJOR <br />CHANGE IN THE INTENT. THE ATTORNEY STATED THAT HE WILL NEED <br />AUTHORITY FOR A LAWSUIT TO CLEAR UP THE TITLE PROBLEM AND PASSAGE OF <br />THE RESOLUTION TO AUTHORIZE THE PURCHASE. <br />COMMISSIONER SCHMUCKER INQUIRED IF THE ESCROWED AMOUNT HAD <br />_TO BE SUCH A SIZEABLE SUM OR WHETHER $10,000 WOULD COVER IT. <br />ATTORNEY COLLINS EXPLAINED THAT THE ALLEGATION IS THAT THE <br />MORTGAGE HAD A VALUE OF $45,000 SO WHAT WE ARE DOING IS COVERING THE <br />COUNTY'S INTEREST TO THE OUTSIDE LIMIT. <br />CHAIRMAN WODTKE NOTED THAT IT IS IMPORTANT THAT WE GET THIS <br />PURCHASE CLOSED BECAUSE WE WILL HAVE A REPORT FROM MR. BEINDORF A WEEK <br />FROM FRIDAY ON THE BIDS RECEIVED AND WE SHOULD BE IN A POSITION WHERE <br />WE HAVE SIGNED THE AGREEMENT SO WE CAN START ON THE RENOVATION <br />PROGRAM. <br />i' <br />ON MOTION BY COMMISSIONER SCHMUCKER, SECONDED BY COMMISSIONER <br />Loy, THE BOARD UNANIMOUSLY AUTHORIZED THE ATTORNEY TO FILE SUIT TO <br />CLEAR UP THE TITLE PROBLEM IN REGARD TO PURCHASE OF THE U.D.U.
