ADVANCE OF PROCEEDS PRIOR TO CLOSING <br />Anything to the Contrary an this contract notwithstanding,, <br />$oyer agrees to advance funds, against the purchase price, to <br />the Seller, prior to closing upon written request from the; <br />Seller. Such funds shall not exceed the sum of Twa Hundred <br />Thousand Dollars {$200,OOO.pO�. The monies so advanced shall not <br />be required to be held in escrow by Seller but may be expended <br />by the Seller in the conduct of its operations and construction <br />program. All monies advanced shall be credited against the <br />purchase price at closing. In the event that Seller's title is <br />'- unmarketable and is not cured in accordance with the provisions <br />of this contract and the Buyer elects to terminate this contract, <br />or if Seller defaults on its contractual obligations and the <br />Buyer elects to cancel the contract or if Buyer cancels the con- <br />bract pursuant to the terms of Paragraph XIV hereof then alI <br />monies advanced to Seller shall be refunded to the Buyer within <br />fafteen {15} days of written demand therefor. <br />XXII.OTHER AGREEMENTS <br />No prior or present agreement or representations shall be <br />i <br />banding upon any of the part�.es hereto unless incorporated in � <br />this contract.
