Barton, <br />Clerk of Circuit Court Indian River County, <br />Florida <br />AMENDED AND RESTATED MEMORANDUM <br />OF <br />LICENSE AGREEMENT <br />This Amended and Restated Memorandum of License Agreement of the Elevated Water Tank <br />Space License Agreement is dated as of 70 day of October , 2015, and is between <br />Indian River County, a political subdivision of the State of Florida ("Licensor") and New <br />Cingular Wireless PCS, LLC, a Delaware limited liability company successor by merger to <br />BellSouth Mobility LLC, a Georgia limited liability company, having a mailing address of 575 <br />Morosgo Drive, Atlanta, GA 30324 ("Licensee"). <br />1. Licensor and Licensee entered into a certain Elevated Water Tank Space License <br />Agreement dated March 23, 2004, as amended by that certain First Amendment to <br />Elevated Water Tank Space License Agreement dated September 10, 2013, for the <br />purpose of installing, operating and maintaining a communications facility and other <br />improvements as described in Exhibit A attached hereto and made a part hereof, together <br />with the improvements thereon ("Premises") and (ii) a Memorandum of License <br />Agreement("Memorandum") dated as of June 1, 2004 and filed for record on June 8, <br />2004, in the Official Records of Indian River County, Florida at Instrument No. 1549608, <br />Book 1742, Page 2186 (the "Memorandum") which Memorandum provides record notice <br />of the License Agreement as it applies to the Premises. <br />1 <br />
