<br /> <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Lowther, the Board unanimously approved <br />the agreement and authorized the Chairman to sign all <br />documents associated with this agreement, as <br />recommended in the memorandum of September 21, 2004. <br /> <br />PARTIALLY EXECUTED AGREEMENT IS ON FILE IN THE <br />OFFICE OF THE CLERK TO THE BOARD <br />11.B.3. COMMUNICATIONS TOWER LEASE AGREEMENT WITH <br />M/A-COM – WEST REGIONAL WASTEWATER PLANT <br /> <br />MOTION WAS MADE by Commissioner Adams, <br />SECONDED by Commissioner Lowther to approve staff’s <br />recommendation. <br /> <br />B. J. McClure <br />, 395 Neiuport Drive, spoke on behalf of the residents in Indian <br />River Aerodrome Subdivision. He declared the location proposed for the antenna tower was in <br />violation of Ordinance 971.44(5), Section 5m(1), and according to Ordinance 971-44(5), Section <br />4(b) the antenna does not meet the criteria to be considered for Special Exception Use. <br /> <br />Planning Director Stan Boling clarified that the regulations Mr. McClure was <br />reading were adopted in 2002 for Wireless Communications Facilities and Towers. He noted three <br />categories from those regulations that apply to the West County Wastewater Treatment Plant and <br />stated that Mr. McClure’s statements were inaccurate. <br /> <br />October 12, 2004 <br />24 <br /> <br />
