Wodtke, Jr. <br />Chairman, Board of County Com" issioners <br />Indian River County ! <br />Post Office Box 8 <br />Vero Beach, Florida 32960 <br />Re: City Water Service - Outside City Limits On <br />Mainland. <br />Dear Bill: ­ <br />Al <br />By letter dated February 22, 1978, John Tittle maileda <br />letter to you requesting that the City and the County come to <br />'an agreement to settle ambiguities -in the bilateral agreement <br />as amended and clarified, and which became effective upon the <br />attachment of Annexes I and II in November of 1973. <br />Paragraph 4 on page 3 of the tentative bilateral agreement <br />of January 11, 1973 provides that: "It is the intent of the <br />County to provide all water and sewer, services to the mainland <br />portion of the County, except within areas where the City now <br />(January 1973) provides water and sewer service." <br />Paragraph 5 on page 4 of the tentative bilateral agreement <br />of January 11, 1973 provides that the City may sell to the <br />County its water distribution facilities in those mainland <br />areas where the City supplies water services only, subject to <br />bond ordinance, a cost formula, and certification by the City's <br />consulting engineer. It is -the City's interpretation that <br />paragraph 5 is still applicable because the one year time period <br />noted therein begins to run upon the County's written request <br />to purchase and not merely within one year from either January 11, <br />1973 or November 6, 1973. <br />The questions regarding; the "areas served in 1973" is further <br />confused by the language on pages 1 and 2 of Annex I to the said <br />agreement where it reads: "The City ray continue to serve those <br />customers connected to the City systems as of the date of this <br />Annex (November 6, 1973), until the County is capable of and <br />authorized to take over such service. The County may provide <br />sewage collection service and water distribution service to the <br />mainland. outside the City subject to paragraph 5, page 4 of the <br />"City (f 1"r.ue6j"11113"Wba <br />�7 <br />
