ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER <br />Loy, THE BOARD AUTHORIZED ATTORNEY COLLINS TO DISCUSS THE USE OF THE <br />31 WATER TAPS RELEASED BY THE MOORINGS WITH THE CITY OF VERO BEACH. <br />PLANNING DIRECTOR REDICK INFORMED THE BOARD THAT HE RECEIVED <br />A TELEPHONE CALL FROM HUD IN ATLANTA RELATIVE TO THE FLOOD INSURANCE <br />ORDINANCE STATING THAT THE ORDINANCE IS DEFICIENT, AND HE ASKED THEM <br />TO GET SOMETHING TO US IN WRITING. PLANNING DIRECTOR REDICK STATED <br />THAT HE AND ATTORNEY COLLINS HAVE PUT TOGETHER A REVISED EMERGENCY <br />FLOOD ORDINANCE. <br />ATTORNEY COLLINS NOTED THAT THE FLOOD ORDINANCE PASSED TWO <br />WEEKS AGO IS EXACTLY THE SAME AS THE ONE PASSED BY BREVARD COUNTY <br />AND APPROVED BY HUD, BUT APPARENTLY THEY HAVE NOW ADDED SOME NEW <br />REQUIREMENTS. HE CONTINUED THAT WHEN MR. REDICK RECEIVED THE LETTER <br />YESTERDAY, THEY AMENDED THE ORDINANCE AND ADDED IN THE ADDITIONAL <br />REQUIREMENTS. <br />PLANNING DIRECTOR REDICK REVIEWED IN DETAIL THE VARIOUS <br />NEW REQUIREMENTS ADDED TO THE ORDINANCE, AND ATTORNEY COLLINS <br />EXPLAINED THAT THIS IS A SITUATION WHERE THE FEDERAL GOVERNMENT <br />HAS MANDATED WHAT YOU -':MUST DO IN ORDER TO GET THE BENEFIT. HE <br />STATED THAT HE AND THE PLANNING DIRECTOR ARE VERY APPREHENSIVE <br />ABOUT THE ORDINANCE, BUT FEEL THAT THIS IS THE BEST THAT CAN BE <br />.DONE UNDER THE CIRCUMSTANCES, <br />.PLANNING DIRECTOR REDICK AGREED THAT THE ORDINANCE SETS <br />OUT THE ABSOLUTE MINIMUM RESTRICTION THAT HE FEELS WE CAN GET <br />BY WITH, <br />MOTION WAS MADE BY COMMISSIONER SIEBERT, SECONDED BY <br />COMMISSIONER LAY, TO DECLARE THAT AN EMERGENCY SITUATION EXISTS <br />AND ADOPT EMERGENCY ORDINANCE N0. 78-25 AMENDING ORDINANCE 78-22 <br />IN TOTO. <br />COMMISSIONER SCHMUCKER EXPRESSED A GREAT CONCERN WITH THE <br />STRINGENT REQUIREMENTS OF THE ORDINANCE WHICH COULD RESULT IN <br />CONSIDERABLE COST FOR A DEVELOPER, BUT AGREED THAT WE HAVE NO <br />ALTERNATIVE, <br />THE CHAIRMAN CALLED FOR THE QUESTION, IT WAS VOTED ON AND <br />CARRIED UNANIMOUSLY, <br />AUG 2 3 1978 <br />49 <br />59 Four 1 <br />
