Attorney Collins provided legal opinion on impact fee tenets. He explained that an <br />impact fee is a Trust Fund that is supposed to be utilized in the area to be impacted by the new <br />development, and said fees could not be spent in another area without undercutting the legitimacy <br />of the impact fee. Board members and staff briefly discussed where they would like to see <br />synchronization. <br />Chuck Mechling, 1999 Pointe West Drive, supported staff's recommendation. <br />There were no other speakers and the Chairman closed the public hearing. <br />ON MOTION by Commissioner Davis, SECONDED by <br />Vice Chair Bowden, the Board unanimously adopted <br />Ordinance 2007-033 amending the text of the <br />Transportation Element of the Indian River County <br />Comprehensive Plan; and providing severability and <br />effective date. <br />9.A.4.
