CONSIDERATION OF PROPOSED AMENDMENTS TO TWO <br />PROVISIONS OF TITLE IX - LAND DEVELOPMENT <br />REGULATIONS - REGARDING THE PROHIBITION OF <br />CITRUS GREENING AND CARIBBEAN FRUIT FLY HOST <br />PLANTS (LEGISLATIVE) <br />PROOF OF PUBLICATION OF ADVERTISEMENT FOR HEARING IS ON FILE IN THE <br />OFFICE OF THE CLERK TO THE BOARD <br />Assistant County Attorney George Glenn recapped his memorandum dated October <br />12, 2007, and explained that the proposed amendment to the Land Development Regulations <br />(LDR) seeks to prohibit citrus greening and Caribbean fruit fly host plants from being planted in <br />new subdivisions. <br />Attorney Glenn reminded the Board of its prior decision on July 17, 2007, directing <br />staff to amend the LDRs to eliminate two varieties of plants (Orange Jasmine and Chinese Box <br />Orange) from new subdivisions, and to exclude these two plants from allowable plantings in <br />landscaped and buffer areas. At the request of the Board, the County Attorney's Office had also <br />researched the legality of prohibiting the sale of these plants from nurseries in the County, and has <br />issued an Opinion that the County is pre-empted by the State from prohibiting the sale of these <br />plants pursuant to Florida Statutes Chapter 581, and the Department of Agriculture Rules. <br />23 <br />October 23, 2007 <br />
