PROPOSED SETTLEMENT OF CHARLES L. <br />LAFEVERS, JR., AS TRUSTEE OF THE JILL V. <br />LAFEVERS TRUST AND SULLIVAN OF VERO BEACH <br />LIMITED PARTNERSHIP V. INDIAN RIVER COUNTY <br />Attorney Collins reviewed his memorandum of October 4, 2006 recommending settlement <br />of the lawsuit by payment of $143,100 ($10 per square foot) to the property owners in exchange <br />th <br />for a deed for title to the property taken during the road improvements to 8 Place. <br /> <br />Administrator Baird recommended they “tear” the road out. <br /> <br />Attorney Collins argued that other people may benefit from the use of the road if they were <br />th <br />driving East to 6 Avenue instead of to US 1. He thought we could still have exposure for <br />damages even if we tore the road out, because for whatever time the road has been there we have <br />been occupying this property. He advised that the County would have to pay the property owner <br />for that use, and would have to pay their attorney fees. <br /> <br />Chairman Neuberger wondered how we ever built on somebody’s property. <br /> <br />October 24, 2006 <br />64 <br /> <br /> <br />
