Under discussion, Vice Chairman Davis said he was fine with the'/2 mile distance <br />for the special notice letter, under Recommendation No. 34, but he wanted to know if the fee for <br />an appeals process could be waived. <br />Attorney Collins stated that there would have to be some rational basis for waiving <br />the fee, but he felt that a case could be made to do so, contingent upon the circumstances. <br />Debate ensued as the Board members explained their respective positions on <br />Recommendation No. 34. <br />The Chairman CALLED THE QUESTION and the <br />Motion carried. The Board, by a 3-2 vote (Commissioners <br />O'Bryan and Wheeler opposed), approved to keep mines <br />in AG -1 under administrative permit. <br />5. ADJOURNMENT <br />There being no further business, the Chairman declared the Meeting adjourned at <br />6:12 p.m. <br />21 <br />October 6, 2008 <br />
