P E R M I T . • <br />THIS PERMIT. issued this 4day of <br />1978, by and between INDIAN RIVER FARKS 14ATER MANAGEMENT DISTRICT, <br />a Drainage District organized and existing under the General <br />Drainage Laws of the State of Florida, whose address is 4400 - 20th <br />Street, Vero Beach,- Florida, hereinafter referred to as the <br />"District", and INDIAN RIVER.COUNTY, a political subdivision of_ <br />the State of Florida, hereinafter referred to as the "County". <br />NOW THEREFORE, the District does hereby grant unto the <br />County a permanent easement for roadway construction, maintenance <br />and use of the General Public on, over, and across the below <br />described property: <br />The North 40' of Section 4, Township 32 South, <br />Range 39 East, lying between the East Right -of - <br />Way line of Kings Highway (S.R. 505-A) and the <br />-Westerly Right -of -,Tay line of Lateral "G" Canal; <br />Together with that portion of Lateral "G" Canal <br />Right of -Way lying contiguous to above described <br />parcel and lying within the North 40' of Section <br />4, Township 32 South, Range 39 East, and the <br />South 40' of Section 33, Township 31 South, Range <br />39 East, <br />provided, however, that as a condition precedent to the rights <br />herein granted, the County agrees to and with the District as <br />follows: <br />1. The County assumes full responsibility for the <br />construction, operation and maintenance of said road right-of-way. <br />2. This Permit may not be assigned or subletted unto <br />a third party. <br />3. That this Permit is subject always to the paramount <br />tight of the District to keep and maintain its drainage district <br />functions and operations. <br />4.
