AGREEMENT <br />THIS AGREEMENT, made this dAy of , <br />19 , by and between the STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, an <br />agency of the State of Florida, hereinafter called the "Department", and <br />hereinafter called the "County"; <br />WITNESSETH': <br />WHEREAS, the parties hereto entered into an agreement dated <br />providing for maintenance by the Department,of roads in the County <br />then designated as secondary roads on the state highway system, for which the <br />County has maintenance responsibility, with the cost of such maintenance to be <br />paid by the County; and <br />WHEREAS, the County is now prepared to perform the maintenance work <br />on such roads and the parties desire to terminate the aforesaid agreement. <br />NOW, THEREFORE, in consideration of the premises -the parties agree: <br />1. The above-described agreement is terminated effective <br />19 , and both parties are thereupon relieved <br />of their obligations thereunder. <br />2. Upon termination of said maintenance agreement, the County assumes <br />full responsibility for the maintenance of the roads described in Exhibits "A" <br />and "C", attached hereto and made a part hereof, and shall maintain in accordance <br />with federal standards those roads or portions thereof, identified in Exhibit "C". <br />d 3. The Department hereby assigns to the County and the County does <br />hereby accept all the rights and responsibilities of the Department under agreements <br />for the sharing with certain railroad companies of maintenance costs for railroad <br />crossings identified in Exhibit "D", attached hereto and made a part hereof. The <br />• railroad company shall be notified of this assignment by copy of this agreement. <br />OCT 41978 <br />
