An initial motion to table failed by a vote of 3-4 and County Administrator Baird <br />suggested a compromise that Phase II be approved on the condition that no further Phases be <br />approved until the Board obtained an independent legal opinion. Attorney Collins recommended <br />that the Commission authorize him to seek an independent legal opinion on the matter. <br />The Chairman liked the idea of reviewing them occasionally. <br />Commissioner Lowther asked for confirmation that this was our only DRI. He also <br />commented on the thorough process and stages of working with a DRI. <br />Attorney Collins agreed it goes through a much more rigorous review, not only local <br />but at the regional level. <br />Further discussion on the subject ensued between the Commissioners. <br /> <br />ON MOTION by Commissioner Bowden, SECONDED by <br />Commissioner Davis, the Board unanimously authorized <br />the County Attorney’s office to obtain an independent legal <br />opinion as to whether development of regional impacts <br />vests for purposes of concurrency when their final <br />development order is issued or, whether subsequent <br />concurrency analysis is required at each subsequent phase <br />of development approval for development of regional <br />impacts, as requested in the memorandum of January 16, <br />2006. <br /> <br />14.A.
