11.J.2 DEVELOPER'S AGREEMENT - THE RESERVE AT GRAND <br />HARBOR - CONSTRUCTION OF OFF-SITE MASTER <br />PLANNED SANITARY SEWER FORCE MAIN AND A <br />REGIONAL SEWER SYSTEM - LEGEND PROPERTIES, INC. <br />MOTION WAS MADE by Commissioner Adams, <br />SECONDED by Commissioner Lowther, to approved <br />staff's recommendation. <br />Commissioner Neuberger questioned if the location of the main entrance had been changed <br />and Ron Andrews, 6414 55th Square, Vice President of Grand Harbor Development clarified that <br />what they see now as the entrance is a temporary modification and he did not believe they intend to <br />make a change from the plans and the entrance will be completed as permitted. <br />Chairman CALLED THE QUESITON, and the <br />motion carried unanimously. (The Board unanimously <br />approved the Developer's Agreement as presented; <br />authorized the Department of Utility Services to <br />recover capacity charges, cost of special gravity sewer, <br />and line extension fees from future developments, and <br />authorized the Chairman to execute the same, as <br />recommended in the memorandum dated January 9, <br />2004, with the corrected backup page 163. <br />January 20, 2004 22 <br />
