LAUDERDALE. <br />THIS EXPENSE IS CHARGEABLE TO THE COMMUNITY DEVELOPMENT PROGRAM. <br />ON MOTION BY COMMISSIONER SCHMUCKER, SECONDED BY COMMISSIONER <br />4 <br />DEESON, THE BOARD UNANIMOUSLY APPROVED OUT -OF -COUNTY TRAVEL FOR <br />COMMUNITY DEVELOPMENT DIRECTOR ED REGAN AND ONE MEMBER OF THE COMMUNITY <br />DEVELOPMENT ADVISORY COMMITTEE TO ATTEND THE FLORIDA COMMUNITY DEVELOP- <br />MENT ASSOCIATION CONFERENCE IN FT. LAUDERDALE, NOVEMBER 1-3, 1978. <br />ATTORNEY RALPH EVANS OF THE FIRM OF COLLINS, BROWN, VAN DE <br />VOORDE & EVANS, APPEARED BEFORE THE BOARD TO REPORT ON THE STATUS OF <br />CONDEMNATIONS ON BARBER AVENUE AND STATE ROAD 60. HE REPORTED THAT <br />TRYING THESE LAWSUITS IS SUBSTANTIALLY MORE EXPENSIVE THAN SETTLING <br />THEM, BUT NOTED THAT THE DOT DOESN'T ALLOW MUCH LEEWAY. HE EXPLAINED <br />THAT AFTER THE ORDER OF TAKING, THE PROPERTY BECOMES THE PROPERTY OF <br />THE STATE, AND YOU CAN BEGIN CONSTRUCTION, BUT MUST DETERMINE THE <br />COMPENSATION TO BE PAID TO THE LAND OWNER, TAKING INTO CONSIDERATION <br />SEVERANCE DAMAGES, ETC. HE INFORMED THE BOARD THAT STATE ROAD 60 IS <br />NOW ACCOMPLISHED AND THE CONTRACT IS TO BE LET NEXT SPRING. <br />ATTORNEY EVANS THEN DISCUSSED THE THREE LAWSUITS FILED RELATIVE <br />TO THE CONDEMNATIONS FOR BARBER AVENUE; INVOLVING LUDEN LUMBER, A-1. <br />CITRUS, AND RALMAR ASSOCIATES. HE NOTED THAT SUFFICIENT DRAINAGE WAS <br />NOT PROVIDED IN THE PLANS FOR THE GROVES ON THE NORTH SIDE OF THE ROAD. <br />PLANS HAVE NOW BEEN PRESENTED THAT CARTER & ASSOCIATES HAVE REVIEWED <br />FOR THE LAND OWNERS AND FOUND SATISFACTORY. MR. EVANS CONTINUED THAT <br />THERE IS AN EXISTING PUMP WHICH IS IN THE RIGHT-OF-WAY. ESTIMATES <br />REFLECT A REPLACEMENT COST OF APPROXIMATELY $8,000 TO $9,000, AND THE <br />OWNERS WISH PAYMENT FOR A NEW PUMP. ATTORNEY EVANS QUESTIONED WHAT <br />HAPPENS TO THE OLD PUMP SINCE THE COUNTY, IN ESSENSE, IS BUYING IT. <br />HE STATED THAT HE IS NOT CERTAIN ABOUT THE RELATIONSHIP OF THE COUNTY <br />AND THE DOT IN REGARD TO THESE LAWSUITS, BUT FELT WE ARE IN THE SAME <br />POSITION NOW AND WILL HAVE TO GO THROUGH TALLAHASSEE, THOUGH IN THE <br />FUTURE THE COUNTY WILL BE TAKING OVER CONSTRUCTION. <br />THE CHAIRMAN THOUGHT THE COUNTY HAS TO SECURE THE RIGHTS-OF- <br />WAY AS OF OCTOBER 1ST, BUT ATTORNEY EVANS POINTED OUT THAT THESE <br />PARTICULAR ONES WERE SECURED PRIOR TO THAT TIME, AND HE HAS ALL THE <br />101 <br />OCT 18 19 <br />8 <br />
