a <br />AMENDMENT TO <br />TEMPORARY EMERGENCY WATER SERVICE AGREEMENT <br />The CITY OF VERO BEACH, a municipal corporation of the <br />State of Florida (City), and INDIAN RIVER COUNTY, FLORIDA <br />VC <br />4 (County), hereby agree as follows, this l 7 day of <br />1978. <br />WHEREAS, on the 24th day of August, 1978, the City of Vero <br />Beach and Indian River County, Florida entered into a Temporary <br />Emergency Water Service Agreement consisting of five (5) pages; <br />and <br />WHEREAS, paragraph 12 of the August 24, 1978 agreement <br />provides that same shall terminate in all events not later than <br />October 30, 1978 without further action by any parties thereto <br />and without liability of any nature whatsoever by the City; and <br />WHEREAS, by letter dated October 16, 1978; the Chairman of <br />the Board of County Commissioners of Indian River County, Florida, <br />William C. Wodtke, Jr., has requested that the agreement of <br />August 24, 1978 be extended for an additional sixty (60) days <br />beyond October 30, 1978; and, <br />WHEREAS, it appears that the City has the utility ability to <br />continue water service to Middle Six and Middle Seven schools <br />under the terms of the August 24, 1978 agreement; <br />NOW, THEREFORE, the agreement of August 24, 1978 is amended <br />as follows and in no other respects: <br />In paragraph 12 on page 3 the words "October 30, 1978" are <br />hereby amended to.read "December 31, 1978." <br />This agreement shall not become effective until same shall <br />be executed by the parties hereto. <br />IN WITNESS WHEREOF, the duly authorized officials of the City, <br />and County, have executed this Amendment to the Temporary Emergency <br />Water Service -Agreement in duplicate, any copy of which may be <br />deemed an original, the date and year first above written. <br />(Signature Page Follows) <br />OCT <br />18 1978 <br />
