McDonald, Jr. <br />ATTORNEY COLLINS STATED THAT HE DOES NOT BELIEVE IT IS <br />NECESSARY TO HAVE A FRANCHISE FOR A SHOPPING CENTER AS THEIR CHARGES <br />FOR THEIR TENANTS FOR SEWER AND WATER.SERVICE ARE USUALLY JUST PART OF <br />THEIR RENT FACTOR. HE NOTED IF THE DEVELOPER WERE TO CHARGE FEES FOR <br />THIS SERVICE, A FRANCHISE WOULD BE REQUIRED. <br />COMMISSIONER SIEBERT FELT THE BOARD SHOULD RESPOND THAT IF <br />THIS IS JUST PART OF THEIR RENT FACTOR, A FRANCHISE WOULD NOT APPLY. <br />COMMISSIONER LOY FELT NO RESPONSE SHOULD BE MADE TO THE <br />DEVELOPERS OF OSLO CENTER UNTIL THE BOARD,HAS SEEN THEIR PLANS, AND <br />THE BOARD AGREED. <br />x313;1 37 PAGE 0 <br />
