Commissioner Wheeler's first concern was with Section 9 of the contract, where it <br />is stated that the Administrator can resign under pressure from one or more Commissioner. He <br />disagreed with that clause. <br />MOTION WAS MADE by Commissioner Wheeler to <br />delete the language in Section 9 of the contract that states <br />that the County Administrator can resign under pressure <br />from one or more commissioners. There was no <br />SECOND. MOTION DIED. <br />Chairman Davis questioned the appropriateness or legality of removing clauses <br />from a signed contract. <br />Attorney DeBraal explained that the Board could revise or change the terms of the <br />contract, but only with Administrator Baird's consent. <br />Administrator Baird, in response, said he would exercise his contract. <br />MOTION WAS MADE by Commissioner Wheeler to <br />remove the statement in Section 8 of the contract that <br />states, "... giving the Administrator 90 days Notice for <br />termination." There was no SECOND. MOTION DIED. <br />While Commissioners debated the pros and cons of the 90 -day Notice, <br />Commissioner Wheeler clarified that his reason for the above Motion, was not a criticism of Mr. <br />Baird, but of the contract. <br />Commissioner Solari pointed out the inappropriateness of the Motions, especially <br />that they lacked a Second, and although he agreed that there were certain terms in the contract <br />January 20, 2009 <br />28 <br />
