TEMPORARY WATER SERVICE AGREEMENT <br />The CITY OF VERO BEACH, a municipal corporation of the State <br />of Florida, (City), and INDIAN RIVER COUNTY, FLORIDA, (County), <br />hereby agree as follows, this �/ _ day of December, 1978: <br />WHEREAS, County shall provide water to a limited number of <br />customers within a specific service territory adjacent to and <br />south of the city limits of the City, formerly being the franchise <br />area (hereinafter "area") of Mid -Florida Utilities, Inc.; and, <br />WHEREAS, Mid -Florida has experienced customers' demand for <br />water in excess of its well field.capacity, and it is anticipated <br />such excess demand will continue from time to time under.County <br />ownership; and, <br />WHEREAS, the County has requested that the City supply the <br />County a limited quantity of water to supplement the existing <br />well field capacity; and, <br />WHEREAS, the City agrees to supply water only under the terms <br />and conditions as are stated herein; <br />NOW, THEREFORE, the parties hereto agree as follows: <br />1. The City shall have no responsibility to provide any <br />services to -the "area".(the former service territory of.Mid- <br />Florida) or any of its customers except as specified in this <br />agreement. <br />2. The City does not guarantee availability of any quantities <br />of water at any pressure for any usage whatsoever, including fire <br />fighting. Service shall be if, as, and when available. <br />3. Any water to -be provided hereunder by the City shall be <br />subject to the availability of said water in the City's water <br />system utilizing only the City's present well fields, present <br />water treatment plant, and present interface connections with the <br />"area", and shall be available only when said capacity, or any part <br />thereof, can be provided by the City without requiring any of the <br />City's present or future water customers to restrict or curtail, <br />even slightly, their usage of City water. <br />4. County assumes all responsibility for any and all damage, <br />loss, or destruction to any part or all of the "area's" system, or <br />ab c 38 W <br />
