<br />THIS AGREEMENT, made and entered into this / day of /--, / 197M,
<br />by and between Pan American Engineering Co., hereinafter called the "Developer"
<br />and Mid -Florida Utilities, Inc., a Florida Corporation hereinafter called "Service
<br />Company".
<br />WITNESSETH:
<br />WHEREAS, Developer owns the following describe, -roperty in Indian River
<br />County, Florida, to -wit:
<br />All that part of the Mao of the NE}, of Section 13, .awnship 33 South, Range 39
<br />East, lying West of the -West right of way of the Florida East Coast Railway,
<br />containing 15 acres, more or less, aaa*i land situate, lying and being in
<br />Indian River County, Florida and
<br />Beginning at the NW corner of the SE4 of i.'i of.Section 13 Township 33 South,
<br />Range 39 East, thence run East 1320 feet,' - to the NE corner of said quarter;
<br />thence 120 feet South, thence West 1320 fee - thence North 120 feet to the
<br />point of beginning, contain 3.64 acres mc:? or less;
<br />Excepting lots 15 and 16 of Block 2; Lots 17, .3 and 19 of Block 3; Lots 1,
<br />5 and 7 of Block 4; and lots 2, 3 and 6 of Blo,_-; 5, .Gloria Gardens, according
<br />to plat filed in the office of the Clerk of the Circuit Court of St. Lucie
<br />County, Florida, in plat Book 5, page 33•
<br />hereinafter referred to as "Developer's Property", and is about to develop
<br />said land by platting it or by const:^ucting buildings, residences, and/or
<br />other improvements thereon; and
<br />WHEREAS, Service Company is willing to ..iithorize the construction, installation
<br />and extension of its central water systeL, and thereafter to operate such
<br />system so that all buildings and/or residences constructed on Developerts
<br />Property by Developer. or by any person,.:firm or coproration holding by, through,
<br />or under Developer, may have furnished to it and to its occupants an adequate
<br />domestic water supply, subject to all the terms and conditions of this Agreement.
<br />NOW, THEREFORE, in consideration of the premises and the mutual undertakings
<br />.and agreements herein contained and assumed, Developer and Service Company
<br />hereby covenant and agree as follows:
<br />1. Developer hereby grants and gives to Service Company, its successors and
<br />assigns, the exclusive, perpetual right, privilege and easement to construct,
<br />reconstruct, install, lay, operate, maintain, repair, replace, improve, alter,
<br />remove, relocate and inspect water transmission and distribution mains, pipe
<br />lines, valves, connections and appurtenant equipment over, across and under
<br />the present and future streets, roads, terraces, alleys, and other public or
<br />private places to be shown on a. plat of Developer's Property that is to be
<br />recorded or on Developer's Property as shown in Water Distributidn Layout
