<br />by and between Rathburn and Williams, Inc., hereinafter called the
<br />"Developor" and Mid -Florida Utilities, Inc., a Florida Corporation, here-
<br />inafter called "Service Company".

<br />VEL EAS, Developer owns the following described property known as Tropic
<br />Grove Condominiums in Indian River County, Florida, to -grit:
<br />Being lot 10 of Vero Land Company Subdivision, recorded in Plat Book 13,
<br />Page 19, Public Records of St. Lucie County, now lying and being in
<br />Indian River County, Florida, and containing 9.7 acres, more or less.
<br />hereinafter referred to as ODeveloparss Property", and is about to develop
<br />said Lund by platting it or by constructing buildings, residences, and/or
<br />other improvements thereon; and
<br />IHMEAS, Service Company is willing to authorize the construction,
<br />installation and extension of its central water system, and thereafter
<br />to operate such system so that all buildings and/or residences con-
<br />structed on Developer's Property by Developer or by wq person, firm or
<br />corporation holding by, through, or under Developer, my have furnished
<br />to it and to its occupnats an adequate domestic water supply, subject
<br />to all the terms and conditions of this Agreement.
<br />NOW, TEMU70M, in consideration of the premises and the mutual under-
<br />takings and agreements herein contained and assumed, Developer and Service
<br />Company hereby covenant and agree as followss
<br />° 1. Developer hereby grants and gives to Service Company, its successors
<br />and assigns, the exclusive,. perpetual right, privilege and easement to
<br />construct, reconstruct, install, Ley, operate, rwi in, repair, replace,
<br />improve, alter, remove, relocate and inspect water trananission and dis-
<br />tribution mains, pipe lines, valves, fire hydrants, connections and
<br />appurtsssant equipment over, across and under the present and future streets,
<br />roads, terraces, alleys, and other yublic or private places 'to -be shown
<br />on a plat of Developer's Property that is to be recorded or on Developer's
<br />property as shown in Ulster Distribution Layout Plans to be prepared by
<br />Beindorf & Associates, Inc., Consultitsg Engineers (said areas hereinafter
<br />being called "Sasemont Areas'), together with the full use, occupation,
<br />and enjoyment thereof for the above described purposes, and all rights
