0 <br />CHAIRMAN WODTKE INFORMED THE BOARD THAT CORRESPONDENCE HAS <br />BEEN RECEIVED FROM AL GARBUTT, SECRETARY OF SUNDOWNERS SUBDIVISION, <br />INC., REQUESTING AN OPPORTUNITY TO COME BEFORE THE BOARD AND DISCUSS <br />THE DRAINAGE SYSTEM AND ROAD CONSTRUCTION IN THEIR SUBDIVISION.. IT IS <br />THEIR CONTENTION THAT THE BOARD HAS SOME RESPONSIBILITY IN THESE AREAS <br />SINCE THEY ORIGINALLY APPROVED THE SUBDIVISION. <br />.JACK DRITENBAS, PRESIDENT OF SUNDOWNERS SUBDIVISION, INC., <br />CAME BEFORE THE BOARD AND INTRODUCED MAX SCONYERS AND .JACK REDISH, <br />DEVELOPERS OF THE SUBDIVISION, AND LEON DALTON, PROPERTY OWNER. HE <br />STATED THAT THE SUBDIVISION, WHICH IS IN AN OLD GROVE, IS LOCATED SOUTH <br />OF 16TH STREET ON 53RD AVENUE AND CONSISTS OF 14 RESIDENTIAL LOTS <br />WHICH AVERAGE 1 TO 1-1/4 ACRES. SEVEN OF THESE LOTS ARE DEVELOPED AND <br />OCCUPIED. MR. DRITENBAS PRESENTED A PLAT FOR THE BOARD TO REVIEW AND <br />STATED THAT THE CRUX OF THE MATTER IS THAT THEY FEEL THE COUNTY SHOULD <br />NOT HAVE APPROVED.THE SUBDIVISION UNTIL IT WAS PROPERLY DONE. HE THEN <br />PRESENTED PICTURES SHOWING THE PROBLEMS, NOTING THAT THERE ARE LARGE <br />TREES IN THE DRAINAGE DITCH AS WELL AS OBSTACLES THAT HAVE NEVER BEEN <br />REMOVED SINCE THE SUBDIVISION WAS APPROVED IN 1974. HE CONTINUED THAT <br />IF THE "ANGLE OF REPOSE" HAD BEEN PUT IN PROPERLY, THEY COULD GET IN AND <br />MAINTAIN THE DITCH, BUT THE SIDES ARE TOO STEEP TO GET EQUIPMENT INI <br />HE THEN DISCUSSED THE ROADS, WHICH HAVE NUMEROUS POTHOLES AND PRESENTED <br />SAMPLES OF BLACKTOP WHICH WERE ONLY 1/2" THICK INSTEAD OF 1". MR. <br />DRITENBAS NOTED THAT THE EDGE OF THE ROAD IS ACTUALLY IN THE CENTER OF <br />' THE RIGHT-OF-WAY, AND HE FELT THE ROADS WERE NOT PUT IN TO ANY SPECIFIC <br />ENGINEERING STANDARDS OR UNDER PROPER SUPERVISION. <br />MR. GARBUTT INFORMED THE BOARD THAT THEY HAVE SPENT $350 <br />PATCHING THE POTHOLES, BUT FEEL THAT WHOLE ROAD WILL HAVE TO BE REDONE. <br />ATTORNEY COLLINS COMMENTED THAT THE SUBDIVISION REGULATIONS <br />DID NOT GO INTO EFFECT UNTIL THE MIDDLE OF 1975. <br />�t ADMINISTRATOR .JENNINGS STATED THAT ENGINEER BEINDORF ADVISED <br />HIM THAT ALTHOUGH HE DID THE ENGINEERING DESIGN FOR THE DEVELOPERS, HE <br />WAS NOT EMPLOYED TO FOLLOW THROUGH ON THE PROJECT. CARTER AND ASSOCIATES <br />WERE EMPLOYED TO STAKE OUT THE PROPERTY AND PREPARE THE ROAD PLANNING, <br />AND APPARENTLY TRODGLEN PAVING DID THE ACTUAL ROAD CONSTRUCTION. THE <br />ADMINISTRATOR POINTED OUT THAT THE SUBDIVISION ORDINANCE WENT INTO <br />11 <br />DEC e 1978' m 38 RLE <br />
