LDRP80’BH <br /> ERTAINING TO UILDING EIGHT <br /> Commissioner Wheeler wanted to direct staff to change the LDR height <br />limitation back to 35 feet, plus 15 feet for the roof, and grandfather the CVS facility west of I-95. <br />(Recently amended special height allowance of 80 feet). Because the character of the County is <br />predicated on density and the tight restrictions on building heights, he felt it is important to <br />maintain the 35’ height limitation. He wants the Board to have public hearings and start from <br />ground zero if there are other requests. <br /> <br /> Commissioner Davis was concerned about the grandfather clause. If there <br />were to be a natural disaster they could rebuild to 80’, but if they have a fire they could not. He <br />thought the best way to address this is to make the LDRS site specific. <br /> Chairman Neuberger responded that it is very specific and felt that the LDRS <br />do not need to be amended. He added that CVS is building less than what is allowed. <br /> Commissioner Wheeler inquired if there is a way to leave an LDR in place that <br />would specifically cover only that site. <br /> County Attorney Collins responded that normally ordinances do apply <br />uniformly throughout the jurisdiction. What was suggested may be possible, but they must avoid <br />being arbitrary. The attempt in the original drafting of the ordinance was to have size requirements <br />and setbacks to preclude this from happening again. <br /> <br />14.A.
