Mr. Paladin reiterated that if these proposals were attached to their permit, they <br />would be happy to assist in any way. He urged the Board to go forward with what was voted on a <br />few weeks ago. <br />Commissioners again reiterated the need to move forward rapidly, either through a <br />pending ordinance or a future moratorium process. <br />MOTION WAS MADE by Commissioner Wheeler, <br />SECONDED by Commissioner O'Bryan, to give staff <br />direction to draft a pending ordinance as quickly as possible <br />to protect the interest of this County. <br />Commissioner Flescher agreed they did not have enough teeth in the ordinance to <br />deal with these issues, and wanted to know what could be done for the here and now. <br />Attorney Collins did not think a Motion for a pending ordinance means anything <br />without some direction as to the content of that ordinance. He reminded the Board of the last time <br />they had a pending ordinance and the issues they had to deal with, and provided legal opinion on <br />the requirements of such a venture. He thought it would be difficult for staff to come back without <br />guidance as to how to proceed. <br />Chairman Bowden agreed with the statements of all Commissioners and the <br />concerns of the County Attorney, but said their first concern should be for health, safety, and the <br />welfare of residents. She also wanted to get the matter resolved expeditiously. <br />Commissioner Wheeler provided a brief synopsis of the issues to be addressed in the <br />pending ordinance. He did not think these mining permits should be under administrative <br />approval, but under public hearings. <br />31 <br />November 20, 2007 <br />
