<br />ON MOTION by Commissioner Lowther, SECONDED by <br />Commissioner Davis, the Board unanimously approved the <br />Modification to Contract for Construction of Required <br />Improvements No. PD-04-04-06-CFCSIDE (99070081) <br />extending the date for completion to August 17, 2008 <br />provided that a replacement irrevocable Letter of Credit in <br />the reduced amount of $25,576.50 is in place prior to <br />November 7, 2007 with an expiration date of November 17, <br />2008 (90 days beyond the August 17, 2008 requested <br />extension date) and authorized the Chairman to execute <br />said Modification, as recommended in the memorandum of <br />October 31, 2006. <br /> If the replacement Letter of Credit is not received by the <br />County Attorney’s Office by 12:00 p.m. on Tuesday, <br />November 7, 2006, the existing Wachovia Irrevocable <br />Standby Letter of Credit Number SM217549W is to be <br />called and this Modification shall be null and void.
