<br />The Board of County Commissioners of
<br />Indian River County, Florida, will, on the 10th
<br />day of January, 1979, at 2:00 P.M., in the Board
<br />of County Commissioners Roam at the Indian
<br />River County Court House, Vero Beach, Indian
<br />River County, Florida, consider granting an
<br />exclusive franchise for a public water system,
<br />to MITCHELL BUILDERS, INC., OF
<br />MICHIGAN AND FLORIDA, to serve the
<br />following described area:
<br />The Southwest Iia of the Northwest %, Less
<br />the South 70 feet for road right-of-way, Section
<br />13, Township 33 South, Range 39 East, Indian
<br />River County, Florida, containing 38.203 acres
<br />net.
<br />Franchise rates and hook-up charges will be
<br />as follows:
<br />MONTHLY WATER QUANTITY RATES
<br />First 2,000 gallons f 7.10
<br />Each additional IAN gallons 1.50
<br />Water Hook-up connection charge 200.00
<br />Parties in interest and citizens will be heard
<br />by the Board at said Public Hearing.

<br />ATTORNEY COLLINS AFFIRMED THAT THIS APPLICATION WAS IN THE
<br />MILL PRIOR TO THE MORATORIUM AND THIS PARTICULAR SUBDIVISION FELL WITHIN
<br />THE EXEMPTION.
<br />ATTORNEY SAMUEL BLOCK CAME BEFORE THE BOARD REPRESENTING
<br />MITCHELL BUILDERS, INC. OF FLORIDA AND MICHIGAN. HE STATED THAT THE
<br />PRELIMINARY PLAT WAS APPROVED LAST APRIL AND THEY ARE COMING IN STRICTLY
<br />FOR THE WATER FRANCHISE ON THAT PLAT. HE INFORMED THE BOARD THAT IN
<br />PARAGRAPH FOUR OF THE APPLICATION, THEY INADVERTANTLY USED THE WORD
<br />"EXCLUSIVE," AND IT WILL BE CHANGED TO A "NON—EXCLUSIVE" FRANCHISE.
