At the direction <br />to the Board, staff and local builders met to discuss this issue and proposed the following <br />ordinance changes: 1) eliminate the need for a contract impairment as a condition for waiving the <br />impact fees, and 2) the time for submission of the completed impact fee waiver application would <br />be moved up to September 30,2005, instead of July 1, 2006. Staff and the Planning and Zoning <br />Commission recommend extending the deadline to apply for the impact fee exemption to January <br />1, 2006, and recommend that all recipients of the impact fee exemption must file complete <br />applications for building permits before June 30, 2006. <br /> <br />The Chairman opened the public hearing, seeing there were no speakers he closed <br />the public hearing. <br /> <br />ON MOTION by Commissioner Bowden, SECONDED by <br />Commissioner Davis, the Board unanimously adopted <br />Ordinance 2005-049, amending Indian River County <br />Ordinance 2005-015 “Title X, Impact Fees”; providing for <br />removing the necessity of impairment to existing contracts <br />before impact fees can be waived: providing for setting <br />December 30, 2005, as the date to submit contracts for <br />consideration; providing for all recipients of impact fee <br />exemptions to file completed applications for building <br />permits by June 30, 2006; providing for codification; <br />providing for severability; and providing for an effective <br />date. <br /> <br /> <br />December 13, 2005 15 <br /> <br />
