E <br />I <br />ATTORNEY COLLINS REPORTED ON THE LEASE OF COUNTY PROPERTY TO <br />RUDY HUBBARD AND EXPLAINED THERE HAS BEEN A DELAY IN PRESENTATION OF THE <br />LEASE BECAUSE IT WAS DETERMINED THAT THE COUNTY DIDN'T OWN THE RIGHT-OF- <br />WAY ON OLD DIXIE, BUT THE DRAINAGE DISTRICT DID. THE ATTORNEY CONTINUED <br />THAT HE IS STILL NOT SATISFIED WITH THE LEASE. ATTORNEY COLLINS ASKED <br />WHAT THE COMMISSION'S ATTITUDE.WOULD BE ABOUT THE 8.26 ACRES BEING USED <br />FOR SOMETHING OTHER THAN A TOWER - FOR INSTANCE, MINI -WAREHOUSES. HE <br />FELT POSSIBLY THE BOARD SHOULD JUST ISSUE MR. HUBBARD A LICENSE TO PUT <br />A TOWER ON THIS PROPERTY BECAUSE UNDER THIS LEASE, MR, HUBBARD CAN DO <br />ANYTHING HE WANTS TO WITH THE PROPERTY FOR $1,000 A YEAR, <br />COMMISSIONER LOY FELT THE INTENT OF THE LEASE WAS STRICTLY TO <br />ALLOW THE PROPERTY TO BE USED FOR A TOWER. <br />COMMISSIONER LYONS INTERJECTED THAT THERE IS USUALLY A LOT OF <br />RENT SPACE ON A HIGH TOWER, AND HE WONDERED IF THE LEASE SHOULD BE <br />PREDICATED ON INCOME. <br />ATTORNEY COLLINS FURTHER POINTED OUT THAT MR. HUBBARD HAS THE <br />RIGHT UNDER THIS LEASE TO SUBLEASE OR ASSIGN TO SOME THIRD PARTY THAT WE <br />DON'T EVEN ANTICIPATE. <br />CHAIRMAN WODTKE LEFT THE MEETING AT 2:08 O'CLOCK P.M. <br />DISCUSSION CONTINUED AS TO THE DESIRABILITY OF A LICENSE <br />RATHER THAN A LEASE. <br />COMMISSIONER SIEBERT COMMENTED THAT THE AMOUNT SET OUT IN THE <br />LEASE WAS AGREEABLE TO HIM AS LONG AS THE PROPERTY WAS ONLY TO BE USED <br />' FOR A TOWER. HE THOUGHT THE SUGGESTION OF ISSUING A PERMIT WAS VERY GOOD. <br />ATTORNEY COLLINS ASKED WHAT WOULD THE COMMISSION'S ATTITUDE <br />BE IF MR. HUBBARD WAS RENTING SPACE ON THE TOWER FOR $2,000 A MONTH., <br />COMMISSIONER LYONS COMMENTED THAT AS LONG AS WE HAVE -USE OF <br />THE PROPERTY WHICH WE WOULD HAVE WITH A PERMIT, HE DIDN'T THINK WE SHOULD <br />BE CONCERNED ABOUT THE PROFIT'HE MAKES OFF THE TOWER, IF WE DON'T HAVE <br />THE USE OF THE PROPERTY, THEN IT WOULD BE DIFFERENT. <br />COMMISSIONER SIEBERT FELT THAT IF SOMEBODY IS- GOING TO MAKE <br />A PROFIT OUT OF USING COUNTY LAND, THE COUNTY SHOULD SHARE IN THE PROFIT. <br />ATTORNEY COLLINS OFFERED TO WRITE ATTORNEY•JOHN SUTHERLAND <br />THAT THE BOARD.
