COMMISSIONER SIEBERT ASKED IF THE STATEMENT IN REGARD TO PRO- <br />VISION OF WATER IS ON THE REPLAT, AND THE ADMINISTRATOR STATED THAT IT <br />IS NOT. HE NOTED THAT HE IS NOW HOLDING IN HIS OFFICE CASHIER'S CHECKS <br />IN THE AMOUNT OF $82,239.20 AS SURETY FOR THE PROPER COMPLETION OF <br />THIS SUBDIVISION. <br />ATTORNEY COLLINS INFORMED THE BOARD THAT ATTORNEY O'HAIRE4HAS <br />CERTIFIED, WITHIN THE LAST TEN DAYS, THAT ALAN MCCAIN IS THE CURRENT <br />OWNER OF THE PROPERTY AND HAS JOINED IN THE DEDICATION SO HE NO LONGER <br />HAS ANY LEGAL PROBLEM WITH THIS PLAT, EXCEPT THAT THE UNDERLYING PLAT <br />MUST BE VACATED. HE FELT THE REPLAT COULD BE APPROVED SUBJECT TO THE <br />STATEMENT ABOUT WATER SUPPLY BEING ADDED, <br />ON MOTION.BY COMMISSIONER $IEBERT, SECONDED BY COMMISSIONER <br />Loy, THE BOARD UNANIMOUSLY GRANTED FINAL APPROVAL TO REPLAT OF OCEANSIDE <br />SUBDIVISION SUBJECT TO THE STATEMENT BEING ADDED THAT "AS OF (DATE), <br />THERE IS NO WATER SUPPLY ON THE PROPERTY." <br />DISCUSSION FOLLOWED ON THE IMPORTANCE OF THE BOARD ASCERTAINING <br />THAT THE CERTIFICATION OF OWNERSHIP IS CURRENT, AND ATTORNEY COLLINS <br />AGREED THAT THIS SHOULD BE ADDED TO OUR CHECK LIST. <br />MR. MCCAIN INQUIRED ABOUT THE POSSIBILITY OF GETTING BACK SOME <br />OF THE MONEY HELD IN ESCROW AS THE ROADS ARE BUILT. <br />ADMINISTRATOR JENNINGS.EXPLAINED THAT THIS MONEY IS HELD IN <br />ESCROW TO ASSURE THE COUNTY THAT THE WORK WILL BE DONE IN ACCORDANCE <br />WITH THE PLANS. HE POINTED OUT THAT THE COUNTY DOES NOT WANT TO BECOME <br />A PAYROLL AGENT FOR THE CONTRACTOR, BUT A PROCEDURE HAS BEEN WORKED <br />OUT, DEPENDING ON THE SIZE OF THE PROJECT, WHERE ONE OR TWO DRAWDOWNS <br />MAY BE OBTAINED, LESS A 15% RETAINER, UPON THE ENGINEER OF THE PROJECT <br />CERTIFYING THAT A CERTAIN PHASE OF THE WORK HAS BEEN COMPLETED, <br />ATTORNEY COLLINS SUGGESTED THAT MR. MCCAIN HAVE HIS ATTORNEY <br />PREPARE A CONTRACT ALONG THE LINES SUGGESTED BY THE ADMINISTRATOR. <br />y� MR. KIRSCH, MR.
