The Commissioners recessed for lunch at 12:20 p.m., and <br />returned to the Chambers at 1:30 p.m.) <br />13.B. APPROVAL OF PURCHASE OF PROPERTY LOCATED AT 1935 43RD <br />AVENUE, MERMAID CAR WASH <br />Attorney DeBraal recapped the backup memorandum of December 8, 2008, to <br />provide background and analysis on the request to purchase the entire Mermaid Carwash <br />property from Timothy and Joshana Tynes. He reported that the Tynes were asking for <br />extended possession until March 31, 2010, with a provision for early taking, which would <br />require payment of $5,000 for every month that the County takes possession prior to that date. <br />He thereafter presented staff's recommendation to approve the Purchase and the Lease <br />Agreements. <br />MOTION WAS MADE by Commissioner Wheeler, <br />SECONDED by Vice Chairman Flescher, to <br />approve staff's recommendation. <br />Commissioner O'Bryan was opposed to the $5,000 penalty for the early take. <br />Discussion ensued as staff responded to questions and comments from the <br />Commissioners regarding the $5,000 penalty.
