ON MOTION by Commissioner Solari, <br />SECONDED by Vice Chairman Flescher, the Board <br />unanimously approved the Agreement to Purchase <br />and Sell Real Estate for the 41st Street right-of-way, <br />with Neil Gaeta, Trustee, and Gaeta Development <br />Company, and authorized the Chairman to execute <br />same, as recommended in the memorandum of <br />December 9, 2008. <br />AGREEMENT IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />13.D. APPROVAL OF MEDIATED SETTLEMENT AGREEMENT FOR PURCHASE <br />OF PROPERTY LOCATED AT THE SOUTHWEST CORNER STATE ROAD 60 <br />AND 66' AVENUE <br />Attorney DeBraal recapped the backup memorandum of December 4, 2008, to <br />provide background and chronology on the Mediated Settlement Agreement for the property <br />owned by State Hwy 60/Kings Hwy LLC. He used an aerial projection to display the subject <br />parcels, and provided details on the County's future road improvement plans for 66th Avenue. <br />He thereafter presented staff's recommendation to approve the Mediated Settlement <br />Agreement for the purchase of the subject property. <br />ON MOTION by Commissioner Wheeler, <br />SECONDED by Chairman Davis, the Board <br />unanimously approved the Mediated Settlement <br />Agreement with State Hwy 60/Kings Hwy, LLC, for <br />37 <br />December 16, 2008 <br />
