Director Boling acknowledged that Section #4, Item (4)(h) has been put back into <br />the Ordinance, and that staff would make any required adjustments where there are references to <br />Section #4, Item (4)(f), which was not approved. <br />Director Boling next presented Section #5, Items (1) — (5)(e), which relates to <br />updating some of the mining permit regulations and site plan requirements. He specifically <br />presented the highlights of Items (3)(a) and (3)(f), found on page 40 of the backup; and Item <br />(3)(k), found on page 41 of the backup. <br />MOTION WAS MADE by Commissioner Solari, <br />SECONDED by Commissioner O'Bryan, to approve staff's <br />recommendations on Section #5, on mining permit <br />regulations, as written. <br />Attorney Ferguson wanted to know if a landscape berm could be added to the <br />"fences, access, control, and other security methods" presented in the safety/security plan <br />outlined in Item (3)(c). <br />Director Boling acknowledged that there might be some situations where the <br />landscape berm would provide security, and there would be no need for a fence. He added that <br />staff had no problem with the addition. <br />Jens Tripson expressed his views on using the landscape berm as a security <br />measure, which triggered further discussion on this topic between Commissioners, staff, Mr. <br />Tripson, and Mr. Kramer. <br />25 <br />December 19, 2008 <br />Special Call Mining Regulations <br />
