The following citizens were in favor of retaining the appeal fee: <br />Chuck Kramer, 10761 US 1 <br />Attorney Ferguson, Ruden McClosky <br />The following citizen opposed having the appeal fee: <br />Susan Boyd, 8025 25th Street <br />Director Boling provided for Commissioner Wheeler further information on the <br />appeal process. <br />Commissioner Wheeler noted that staff had been directed by the Commissioners <br />(minus Commissioner Solari) to add the provision regarding the waiver of the fee for appealing a <br />PZC decision. <br />The Chairman CALLED THE QUESTION, and by a 2-2 <br />vote (Vice Chairman Flescher and Commissioner Solari <br />opposed, Chairman Davis recused himself,), the Motion to <br />approve Section #11, Item (1)(b)(4), and to approve Sections <br /># 12, # 13, # 14, and # 15 FAILED. <br />ON MOTION by Commissioner O'Bryan, SECONDED by <br />Commissioner Solari, by a 4-0 vote (Chairman Davis recused <br />himself), the Board unanimously approved to delete from <br />Section #11, Item (1)(b)(4). <br />36 <br />December 19, 2008 <br />Special Call Mining Regulations <br />
