Vice Chairman Ginn had a problem with that because the Commissioners did not <br />know the whole story. <br />Mr. Johnson asked if there could be discussion on moving the pharmacy location <br />so that the entrance and exit is on Oslo Road and not on a new bridge being built over a <br />lateral canal. <br />(CLERK=S NOTE: At approximately 11:31 a.m., Commissioner Adams & <br />Commissioner Lowther temporarily left the meeting.) <br />order. <br />Chairman Macht thought the history of this appeared to be happening in reverse <br />Commissioner Neuberger specified that right-of-way acquisition was required and <br />it would have been done either way. <br />Director Davis explained that an agenda memorandum in July disclosed that the <br />County was paying residential prices for the right-of-way and that the seller was entitled to <br />apply to the Community Development Department for an increase in the depth of their <br />commercial zoning. He noted that the Board could deny the rezoning and then staff would <br />probably have to go back to the seller and pay the higher (commercial) value for the same <br />right-of-way. Paragraph 8 in the right-of-way contract addressed this procedure. <br />(CLERK=S NOTE: At approximately 11:35 a.m., Commissioner Lowther returned <br />to the meeting.) <br />There was discussion as what type of development would be allowed on the <br />property should the rezoning be denied. <br />Commissioner Lowther advised that people are worried about extending the <br />December 2, 2003 <br />23 <br />
