<br /> <br />Director Bob Keating briefed the Board of the process taken that lead up to this <br />denial. Ms. Terranova’s application was logged in and sent to the attorney’s office for <br />review of her contract to determine whether the contract would be impaired by the impact <br />fees and it was determined that it would not be impaired. <br /> <br />Attorney Collins added that later in December 2006, the Board deleted the <br />requirement that the contract be impaired. <br /> <br />Administrator Baird stated that staff does not have the ability to act on impact <br />fees and that is why this item came to the Board. <br /> <br />ON MOTION by Commissioner Davis, SECONDED <br />by Chairman Wheeler, the Board unanimously <br />approved an impact fee increase exemption for Marie <br />Terranova. <br /> <br />Chairman Wheeler called for a recess at 10:34 a.m. and he reconvened the <br />meeting at 10:38 a.m. <br /> <br />9.C.
