Staff recommended approval with the conditions as listed. <br />There were no questions of staff <br /> <br />The Chairman opened the public hearing. <br /> <br />th <br />Bruce Moia <br />, of Mosby, Moia, and Bowles, 2455 14 Avenue, the project engineer, <br />was present to answer questions and to request approval of the special exception. <br /> <br />There were no additional speakers and the Chairman closed the public hearing. <br /> <br />ON MOTION by Commissioner Davis, SECONDED by <br />Commissioner Lowther, the Board unanimously found that <br />it is empowered under the provisions of Chapter 971 to <br />review the special exception applied for; that the granting <br />of the special exception will not adversely affect the public <br />interest; and that the application satisfies the general and <br />specific criteria required for special exception approval; <br />and granted special exception approval for the proposed <br />used vehicle sales business with the following conditions: <br />prior to issuance of a certificate of occupancy the applicant <br />shall: construct or bond out the required US Highway 1 <br />sidewalk, and install all required landscaping as shown on <br />the site’s landscape plan; and the site will be required to <br />connect to public sewer if any future repairs are required for <br />the septic system, all as recommended in the memorandum <br />of December 6, 2004. <br />December 7, 2004 <br />17 <br /> <br />
