<br />Commissioner Wheeler WITHDREW HIS SECOND in <br />anticipation of a new, more specific motion. <br /> <br />County Administrator Baird requested they exempt the ¼ and ⅓ acre lots; it would <br />be a lot easier for staff to implement. <br />The Chairman polled the Commission and there were three Commissioners who <br />favored the ¼-acre provision. <br />Discussion ensued. <br /> <br />MOTION WAS MADE by Commissioner Wheeler, <br />SECONDED by Chairman Neuberger, to exempt ¼ acre <br />and smaller lots, to have no tree advisory committee, to add <br />two new members to the PSAC to monitor trees, easement <br />language excluded, 2″ caliper not 3″ caliper, and the rest as <br />staff had recommended, with an effective date in 90 days. <br /> <br />County Administrator Baird reminded the Commissioners that it would take a <br />budget amendment to implement enforcement of this ordinance. <br /> <br />The Chairman CALLED THE QUESTION and the Board, <br />by a vote of 4-1 (Commissioner Davis opposed), adopted <br />Ordinance No. 2004-041 amending Chapters 901, 912, 926, <br />and 927 of the Land Development Regulations (LDRS) <br />relating to tree protection and landscaping requirements; <br />revising definitions of “protected” and “specimen” trees; <br />strengthening specimen tree protection requirements; <br />requiring a 2 to 1 replacement ratio for the removal of <br />hardwood trees 12 inches or more in diameter; requiring <br />December 7, 2004 <br />31 <br /> <br />
