mining regulation LDR amendments, which includes <br />changing mining to special exception use. <br />The Chairman called a recess at 6:31 p.m., and reconvened the meeting at 6.•45 <br />p.m., with all members present. <br />The Chairman announced that staff's Version 2, to keep mining as an <br />administrative permit use, would be discussed at this time. <br />Director Boling reminded the Board that the mining moratorium had been in effect <br />since January 7, 2008, and any changes to the mining regulations must be made prior to January <br />7, 2009, when the moratorium ends. He outlined the activities engaged in by staff and PZC as <br />the mining regulations were reviewed; detailed some of the issues and concerns which had arisen <br />during the PZC meetings; and summarized some of the proposed changes to the mining LDR's. <br />He conveyed that the PZC Chairman had felt there was a consensus that the new mining <br />regulations would apply to the three pending applications "in the pipeline," as well as to any <br />future mining concerns. <br />Chairman Davis sought and received legal opinion from Attorney Collins <br />regarding applying the new regulations to the three pending applications. <br />MOTION WAS MADE by Commissioner Solari, <br />SECONDED by Vice Chairman Flescher, for the proposed <br />mining regulations for Version 2, to apply to the three <br />mining applications "in the pipeline." <br />Chairman Davis voiced concerns about the applicants whose permits have been <br />delayed during the mining moratorium, wondering whether they would encounter another <br />8 <br />December 8, 2008 <br />
