MORICA <br />3198® <br />L E A S E <br />THIS LEASE made and entered into this 19th day of <br />March 011979, by and between, COUNTY OF INDIAN RIVER, a politi- <br />cal subdivision of the State of Florida, hereinafter referred to <br />as LESSOR, and MITCHELL BUILDERS,INC. OF MICHIGAN AND FLORIDA, <br />a Florida corporation with its principal place of business*in <br />Vero Beach, Indian River County, FLorida, hereinafter referred <br />to as LESSEE: <br />WITNESSETH, That the said Lessor does this day lease <br />unto the said Lessee, and the Lessee does hereby hire and take <br />as tenant, those certain water distribution lines situated <br />underground on the real property more particular described in <br />that certain Indain River County Board of County Commissioners <br />Resolution No. 79-12, known as the MITCHELL BUILDERS,INC. OF <br />MICHIGAN AND FLORIDA WATER FRANCHISE, hereinafter referred to as <br />WATER FRANCHISE, and described as follows: <br />All that part of Indian River County, Florida <br />located within the following described boundary <br />lines to -wit: <br />The Southwest 1/4 of the Northwest 1/4, less the <br />South 70 feet for road right-of-way, Section 13, <br />Township 33 South, Range 39 East, Indian River <br />County, Florida, containing 38.203 acres net. <br />It is understood and agre ed that the water plant• <br />located on the above real property, and the real property of the <br />Lessee, is not part of this Lease. <br />Said above described water distribution lines located <br />and situated underground on the above described real property, <br />are to be hold and used by the Lessee in the operation of a water <br />distribution business and for no other purposes or uses whatso- <br />ever, for the term of this lease, beginning on the 19th day of <br />March ,1979, and ending pursuant to the provisions of <br />Section XXI of said Water Franchise Resolution 79-12, at and for <br />the agreed total annual rental of ONE DOLLAR ($1.00). <br />The following express stipulations and conditions are <br />made a part of this lease and are hereby assented to by the <br />Lessee: <br />Bou 39 PAGE 334 <br />
