N <br />ZONING DIRECTOR WALKER NEXT DISCUSSED A RELEASE OF EASEMENTS <br />IN INDIAN RIVER HEIGHTS, AS REQUESTED BY CHARLES AND LAURA STEMBERG, <br />HE CONTINUED THAT THIS IS DIFFERENT FROM THE AVERAGE REQUEST. HE <br />QUOTED MR. .JENNINGS AS SAYING THAT HE WOULD NOT LIKE TO SEE -THIS ABAN- <br />DONED BECAUSE THE OVERALL DRAINAGE -WOULD CAUSE A HARDSHIP. ZONING <br />DIRECTOR WALKER STATED THAT VERY SELDOM WILL HE SPEAK AGAINST AN ABANDON- <br />MENT, BUT HIS DEPARTMENT DOES NOT BELIEVE THAT THE EASEMENT PLAYS A <br />HARDSHIP ON THE USE OF THE STEMBERGIS POOL., HE CONTINUED ON THAT THE <br />STEMBERGS HAVE REQUESTED 4' TO BE ABLE TO FULLY UTILIZE THE POOL. THE <br />ZONING DIRECTOR THEN DISTRIBUTED PHOTOGRAPHS TAKEN OF THE HOUSE AND <br />POOL,AND IT WAS NOTED THAT THE ROOF HAS AN ILLEGAL OVERHANG OF 2'. HE FURTHER <br />STATED THAT THE STEMBERGS DO HAVE A FENCE PERMIT FOR THE PROPER SETBACKS, <br />BUT NOW ARE ASKING FOR 4' TO BE ABLE TO SET IT BACK FURTHER. <br />COMMISSIONER.LOY REAFFIRMED THAT THE STEMBERGS' REQUEST WAS <br />FOR 4' OF THE 12' EASEMENT. SHE ALSO NOTED THAT THERE ARE 24' BETWEEN <br />THE STEMBERG'S HOUSE AND THE HOUSE NEXT DOOR. <br />ZONING DIRECTOR WALKER REPORTED IT WAS THE DRAINAGE EASEMENT <br />AND SOME DAY MAY BE USED FOR SEWER PIPE INSTALLATION. <br />COMMISSIONER LYONS, IN LOOKING AT THE PHOTOGRAPHS, ASKED IF <br />THE ZONING DEPARTMENT FELT THE STEMBERGS NEEDED -ADDITIONAL SPACE, AND <br />THE ZONING DIRECTOR REPLIED NEGATIVELY, . <br />COMMISSIONER LOY ASKED IF THERE HAVE BEEN ANY OTHER REQUESTS <br />MADE FROM THIS AREA, AND ZONING DIRECTOR WALKER ADVISED THE BOARD THERE <br />HAVE NOT BEEN ANY. <br />ZONING DIRECTOR WALKER WENT ON TO EXPLAIN THAT INDIAN RIVER <br />HEIGHTS IS THE FASTEST GROWING SUBDIVISION THE COUNTY HAS EVER HAD AND <br />THERE ARE VERY FEW LOTS REMAINING IN THIS SUBDIVISION, WHICH HAS SEVEN <br />OTHER PLATS OF RECORD. <br />-,� DISCUSSION ENSUED REGARDING THE RESTRICTIONS' ON THE DEEDS, <br />AND COMMISSIONER DEESON NOTED THAT SOME PEOPLE DO NOT REALIZE WHAT THEIR <br />RESTRICTIONS ARE,BUT THEIR CONTRACTORS SHOULD CERTAINLY ADVISE THE <br />OWNERS OF THEM', <br />mg <br />10 <br />BOOK 39 PAGE 364 <br />
