0 <br />COUNTY DOESN'T PROVIDE SERVICE WITHIN SEVEN YEARS. HE NOTED THIS MONEY <br />WILL BE PAID BY INDIVIDUAL PROPERTY OWNERS, AND HE FELT THIS MIGHT BE <br />CLASSIFIED AS "WINDFALL PROFIT." ATTORNEY COLLINS DID NOT FEEL SO. <br />THE CHAIRMAN THEN NOTED THAT IT STATES THAT CORPORATIONS SHALL <br />MAINTAIN CURRENT AND SEPARATE SETS OF BOOKS FOR THE FRANCHISE OPERATION. <br />HE FELT IT MIGHT BE GOOD TO REQUIRE THAT THEY GIVE AN ANNUAL COPY OF <br />THEIR AUDIT AND TAX RETURN TO THE BOARD OR SOMETHING ON A PERIODIC BASIS <br />SO WE CAN HAVE FINANCIAL INFORMATION ON THE CONDITION OF THE CORPORATION. <br />COMMISSIONER LOY AGREED AND FELT SOMETHING SHOULD BE INCLUDED <br />ABOUT THE KIND OF INFORMATION THAT WILL BE NECESSARY WHEN THEY COME TO <br />THE BOARD FOR A HEARING ON RATE INCREASES. <br />CHAIRMAN WODTKE NEXT INQUIRED IF WE HAVE LANDSCAPE REQUIRE- <br />MENTS SUCH AS DISCUSSED ON PAGE 4. <br />COMMISSIONER SIEBERT POINTED OUT THAT UTILITIES REQUIRE SITE <br />PLAN APPROVAL, AND THIS CAN REQUIRE LANDSCAPING. ATTORNEY COLLINS STATED <br />THAT IT IS HIS UNDERSTANDING WE DO HAVE SUCH REQUIREMENTS. <br />COMMISSIONER LYONS STATED THAT HE WOULD LIKE TO HAVE THE LAND- <br />SCAPING, BUT WAS NOT SURE WE COULD ENFORCE IT. <br />ATTORNEY COLLINS NOTED THAT IF THE CORPORATION AGREES TO DO <br />CERTAIN THINGS, WE CAN ENFORCE THAT,AND THAT IS WHY IT IS INCLUDED IN <br />THE FRANCHISE. <br />CHAIRMAN Y'iODTKE INQUIRED IF THE ATTORNEY IS SAYING THERE WILL <br />BE TWO TYPES OF FRANCHISES - ONE FOR AREAS WHERE WE WILL NOT BE FOR A <br />LONG TIME, ETC. <br />ATTORNEY COLLINS EXPLAINED THAT IT MAKES SENSE FOR THE COUNTY <br />TO OWN LINES WHERE WE FEEL WE WILL HOOK ON IN FIVE YEARS OR SO, BUT IF <br />THE COUNTY SHOULD FEEL THIS WILL NOT OCCUR FOR IO OR 15 YEARS, HE <br />QUESTIONED WHETHER THE COUNTY WOULD WANT THAT RESPONSIBILITY, EVEN THOUGH <br />THE LINES ARE LEASED BACK, <br />COMMISSIONER SIEBERT AGREED THAT IS REASONABLE, AND HE FELT <br />SUCH A DETERMINATION CAN BE MADE AT THE HEARING ON THE FRANCHISE. <br />COMMISSIONER Loy COMMENTED THAT WHAT WE WANT IS.A MODEL TO <br />GO BY, SHE AGREED THERE ARE MANY EXTENUATING CIRCUMSTANCES AND THAT WE <br />31 <br />BOOK 39 PAGE 385 <br />V <br />
