Change Order #8 (re -roofing building C) in the amount of <br />$157,300.00, and authorized the Chairman to execute the <br />Change Order after the County Attorney's office has <br />reviewed and approved the document, as recommended in <br />the memorandum of January 25, 2007. <br />7.DD. PERMISSION TO ADVERTISE FOR PUBLIC HEARING <br />FEBRUARY 20, 2007, FOR PROPOSED ORDINANCE <br />PROHIBITING ALL TERRAIN VEHICLES ON UNPAVED <br />ROADWAYS <br />Commissioner Davis argued, "We need to do something about making residential <br />streets safe," and felt the issue might require State legislative help. He believed that if the County <br />passes this ordinance it would create a problem with regards to legitimate agricultural purposes <br />because some people are convinced an ATV is not necessarily a recreational vehicle but it is also a <br />piece of farm machinery. <br />Chairman Wheeler wondered if there was a way they could incorporate in the <br />ordinance, with classifications for our County, a criteria where they could register a vehicle as <br />farm machinery and establish in our County that it is used for agriculture. <br />Attorney Collins doubted they could do that, stating that the State pre-empts this <br />field in terms of definition of what is a farm vehicle. He discussed the distinction between <br />operation on public and agricultural roads and offered to look at the issue to see if there was <br />another option. <br />February 6, 2007 18 <br />
