ATTORNEY COLLINS POINTED OUT THAT THE DEFINITION OF NURSING <br />HOMES IN OUR ZONING ORDINANCE INCLUDES RETIREMENT CENTERS AND IF THE <br />PROPOSED ORDINANCE IS ADOPTED, SOMEONE COULD COME IN AND REQUEST A <br />RETIREMENT CENTER IN C -IA AND WE COULD NOT REFUSE IT. <br />CHAIRMAN WODTKE ASKED IF WE COULD EXCLUDE RETIREMENT CENTERS <br />IN OUR MOTION, AND THE ATTORNEY STATED THE ONLY WAY TO EXCLUDE THEM <br />WOULD BE TO CHANGE THE DEFINITION IN OUR ZONING ORDINANCE. HE SUGGESTED <br />THAT THE BOARD INSTRUCT THE PLANNING DEPARTMENT TO COME UP WITH A NEW <br />DEFINITION FOR NURSING HOMES WHICH WILL EXCLUDE RETIREMENT CENTERS. <br />DISCUSSION CONTINUED AND COMMISSIONER LYONS FELT WE ARE IN A <br />PERFECTLY SAFE POSITION TO GIVE THE PLANNING DEPARTMENT TIME TO CHANGE <br />THE DEFINITION SINCE "TO GET ANOTHER CERTIFICATE OF DEED FOR THIS COUNTY <br />IN THE IMMEDIATE FUTURE WOULD BE DIFFICULT OR IMPOSSIBLE. <br />ATTORNEY COLLINS DISAGREED BECAUSE SOMEONE COULD COME IN WITH <br />A RETIREMENT PROJECT THAT WOULD COME UNDER THE DEFINITION OF NURSING <br />HOME THAT IS BEING'ALLOWED IN THE C -IA AREA, BUT HE DID AGREE THAT CHANCES <br />ARE THAT THERE IS LITTLE OR NO RISK INVOLVED UNTIL WE CAN REDEFINE. <br />DISCUSSION ENSUED AS TO SETTING ASIDE THE ACTUAL ADOPTION OF <br />THE ORDINANCE UNTIL WE CAN ADOPT THE NEW DEFINYTIDN*." COMMISSIONER Loy <br />INQUIRED ABOUT THE TIME SCHEDULE DESIRED BY ATTORNEY COOKSEY, AND HE <br />STATED THEIR CERTIFICATE OF MEED IS GOOD UNTIL NEXT .DUNE BUT THEY NEED <br />AS MUCH LEEWAY AS POSSIBLE. <br />IN FURTHER DISCUSSION, IT WAS FELT A PUBLIC HEARING ON RE- <br />WORDING THE DEFINITION IN THE ZONING ORDINANCE COULD BE HELD ON AUGUST <br />8TH AND THE SUBSEQUENT ORDINANCE COULD BEC"OME EFFECTIVE AUGUST 9TH, <br />COMMISSIONER LYONS WITHDREW HIS PREVIOUS MOTION TO REWORD <br />SAME, AND COMMISSIONER SIEBERT {^WITHDREW HIS SECOND. <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER <br />SIEBERT, THE BOARD UNANIMOUSLY ADOPTED ORDINANCE 79-I8 ADDING NURSING <br />HOMES AS A SPECIAL EXCEPTION UNDER C -IA, SAID ORDINANCE TO BECOME <br />EFFECTIVE AUGUST 9, 1979. <br />30 <br />J U L 51979 BOOK 41PAGE gT <br />
