CJ <br />ATTORNEY COLLINS INFORMED THE BOARD THAT NO DATE WAS APPROVED - <br />FOR STARTING THE PROPERTY APPRAISAL ADJUSTMENT BOARD MEETINGS, AND <br />-THERE IS A 30 DAY NOTICE REQUIREMENT. <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER Loy, <br />THE BOARD UNANIMOUSLY AUTHORIZED THE ATTORNEY TO ADVERTISE THE FIRST <br />PROPERTY APPRAISAL ADJUSTMENT BOARD MEETING FOR MONDAY, AUGUST 13, 1979, <br />AT 9:00 A.M. <br />ATTORNEY COLLINS ASKED IF THE BOARD WISHED HIM TO WORK WITH <br />THE PLANNING DEPARTMENT TO REDRAFT THE SITE PLAN ORDINANCE AS TO THE <br />MATTERS DISCUSSED TODAY, I.E., TRAFFIC FLOW, CLEARING, OF LAND, DRAINAGE, <br />ETC., AND THE BOARD AGREED THAT THEY DID. <br />ATTORNEY COLLINS REPORTED THAT COMMISSIONER LYONS ASKED HIM <br />FOR A RECOMMENDATION ON THE APPEAL SITUATION. HE STATED THAT HE DID NOT <br />FEEL THE BOARD*SHALL CALL FOR AN APPEAL ON SOMETHING THAT WILL COME <br />BEFORE THEM, BUT THAT THE CALL FOR THE APPEAL SHOULD COME FROM.A THIRD <br />PARTY. HE NOTED THAT THE APPEAL LANGUAGE HE HAS FOUND IN RESEARCH <br />REFERS TO AN "AGGRIEVED PARTY. If HE DID NOT FEEL THAT WOULD CAUSE MUCH. <br />OF A PROBLEM AND RECOMMENDED USING THIS TERMINOLOGY, WHICH WOULD PRETTY <br />MUCH LET ANY TAXPAYER COME IN WITH AN APPEAL. HE STATED THAT IF IT <br />GETS ABUSED, THEN IT CAN BE CHANGED. <br />COMMISSIONER SIEBERT ASKED WHAT IS WRONG WITH THE BOARD CALLING <br />FOR AN APPEAL, AND THE ATTORNEY FELT IT WOULD INDICATE THAT THE BOARD <br />HAS A PRECONCEIVED ATTITUDE, AND FURTHER NOTED THAT HE WOULD NOT LIKE <br />TO HAVE THE GOVERNING BOARD DETERMINING WHETHER OR NOT THERE WILL BE AN <br />APPEAL. <br />COMMISSIONER LYONS AGREED WITH THE LANGUAGE PROPOSED BY THE <br />ATTORNEY AND DOUBTED WE WILL HAVE ANOTHER APPEAL IN THE NEXT THREE YEARS, <br />-DISCUSSION FOLLOWED, AND CHAIRMAN WODTKE STATED THAT HE DOES <br />NOT WANT THE STAFF OF THE PLANNING DEPARTMENT TO BE BURDENED WITH <br />PEOPLE REQUESTING TO HAVE SITE PLANS EXPLAINED TO THEM. <br />ANN ROBINSON NOTED THAT THE CITY OF VERO BEACH ALLOWS ANY <br />INTERESTED PERSON TO MAKE AN APPEAL AND SHE DID NOT BELIEVE THEY HAVE <br />14AD BUT ONE IN THE LAST SEVEN OR EIGHT YEARS. <br />61 <br />JUL 51979 <br />R00 PA -F8 <br />
