THIS AGREEMENT MADE THIS 20th DAY OF June <br />A.D., 1979, BY AND BETWEEN THE INDIAN RIVER COUNTY <br />BOARD OF COUNTY COMMISSIONERS, FLORIDA, HEREINAFTER <br />CALLED THE OWNER, AND SVERDRUP & PARCEL AND ASSOCIATES, <br />INC. AND BEINDORF AND ASSOCIATES, INC. (A JOINT VENTURE), <br />HEREINAFTER CALLED THE ENGINEER. <br />WITNESSETH, THAT WHEREAS, the Owner has reviewed the qualifications <br />of professional engineering firms as required by Chapter 73-10, Florida <br />Statutes, and <br />WHEREAS, the Owner desires to obtain certain professional engineering <br />and planning services for A County Bridge Inspection and Report Program, and <br />WHEREAS, The Owner has determined the firm of Sverdrup & Parcel and <br />Associates, Inc. and Beindorf & Associates, Inc. (A Joint Venture) to be <br />the -most qualified firm for professional services required by the Owner, and <br />WHEREAS, the Engineer warrants that he has not employed or retained any <br />company or person, other than a bona fide employee working solely for the <br />Engineer, to solicit or secure this Agreement, and that he has not paid or <br />agreed to pay any person, company, corporation, individual, or firm, other <br />than a bona fide employee working solely for the Engineer, any fee, commission, <br />percentage, gift, or any other consideration, contingent upon or resulting <br />from the award or making of this Agreement. <br />NOW, THEREFORE, the Owner and the Engineer for the consideration herein- <br />after set forth agree as follows: <br />SECTION 1. BASIC SERVICES OF THE ENGINEER <br />A. General <br />1. The Engineer agrees to perform professional services in <br />connection with the project as hereinafter stated. <br />2. The Engineer shall serve as the Owners professional <br />representative as related to the project, and shall give consultation and <br />advice to the Q.mer during performance of his services. <br />3. Preliminary investigation and comprehensive field investi- <br />gation will be performed and a bridge report shall be prepared for each bridge <br />at the location shown on Attachment "A". The total number of bridges shown on <br />Attachment "A" is 89 which includes the high-level Wabasso bridge on SR 510 <br />over the Indian River. The Owner may add or delete -to the number of bridges <br />as shown on Attachment "An.
