13.B. MENSING REQUEST FOR RIGHT-OF-WAY ABANDONMENT <br />Commissioner Solari did not think it was appropriate to discuss this matter <br />because it was discussed at the last Commission Meeting and there was no additional data to <br />indicate anything had changed since. Further, the County Attorney's recommendation was not in <br />the packet, and since Mr. Mensing has threatened legal action, thought it was best if Mr. <br />Mensing handles this matter in court and the Board not spend its time rehashing something they <br />spent a lot of time discussing at the last meeting. Commissioners agreed the item should be <br />pulled. <br />ON MOTION by Commissioner O'Bryan, <br />SECONDED by Commissioner Wheeler, the Board <br />by a 4-1 vote (Vice Chairman Flescher dissenting) <br />approved to take no action on this Item. <br />13.C. ACQUISITION OF RIGHT-OF-WAY AND DRAINAGE EASEMENT <br />ALONG 66THAVENUE <br />Deputy County Attorney William DeBraal updated the Board on the negotiations <br />with Vista Properties of Vero Beach regarding the County's desire to purchase right-of-way and <br />a drainage easement for taking stormwater runoff from the expanded 66th Avenue from SR 60 to <br />26th Street. <br />ON MOTION by Commissioner Wheeler, <br />SECONDED by Vice Chairman Flescher, the Board <br />unanimously approved the Contract for purchase of <br />the Vista Properties right-of-way and drainage <br />easement parcels for a total of $339,200.00, as <br />recommended in the memorandum of March 9, 2009. <br />March 17, 2009 32 <br />
