JUL 181979 <br />P00� 41 PAGE 225 <br />COMMISSIONER LYONS NEXT DISCUSSED SITE PLAN APPLICATIONS, AND <br />SUGGESTED THAT BEFORE A BUILDING PERMIT IS ISSUED, WE SHOULD HAVE SOME <br />WAY TO BE ASSURED THAT ALL NECESSARY STATE AND FEDERAL PERMITS HAVE <br />BEEN OBTAINED. HE NOTED THAT ATTORNEY COLLINS IS IN THE PROCESS OF <br />REVISING THE SITE PLAN PROCEDURES AND REQUESTED THAT ATTORNEY BROWN <br />RELAY THIS SUGGESTION TO ATTORNEY COLLINS. <br />ADMINISTRATOR JENNINGS ASKED IF COMMISSIONER LYONS IS SAYING <br />THAT YOU GO THROUGH SITE PLAN REVIEW, BUT SITE PLAN APPROVAL WILL NOT <br />BECOME FINAL UNTIL ALL PERMITS ARE RECEIVED FROM THE REQUIRED GOVERN- <br />MENTAL AGENCIES? <br />COMMISSIONER LYONS STATED THAT THE SITE PLAN WILL BE APPROVED, <br />BUT IT WILL NOT BECOME OPERATIVE UNTIL ALL THE NECESSARY PERMITS ARE <br />OBTAINED. <br />THE CHAIRMAN FELT THAT IS BASICALLY THE WAY IT IS NOW. <br />ADMINISTRATOR .JENNINGS DID NOT FEEL IT IS. HE STATED THAT <br />YOU CAN 'GET SITE PLAN APPROVAL AND THEN THE DEVELOPER CAN GO ON AND GET <br />THE BUILDING PERMITS AND PROCEED, WHICH LEAVES IT UP TO THE GOVERN- <br />MENTAL AGENCIES TO BE THE ENFORCING AGENCIES. <br />ATTORNEY BROWN, WHO ACTS AS ATTORNEY FOR THE ZONING BOARD, <br />DID NOT AGREE. HE NOTED THAT MANY TIMES THE ZONING BOARD SPECIFICALLY <br />ADVISES A DEVELOPER THAT THEY ARE APPROVING HIS SITE PLAN, BUT THAT THEY <br />ARE NOT MAKING ANY COMMENT ON ANY OF THE OTHER PERMITTING THAT IS <br />REQUIRED AND THAT HE MUST OBTAIN THE NECESSARY PERMITS BEFORE THE <br />BUILDING DEPARTMENT WILL ISSUE HIM A BUILDING PERMIT. ATTORNEY BROWN <br />CONTINUED THAT, AS HE UNDERSTANDS IT, THE BUILDING DEPARTMENT HAS A <br />CHECK LIST OF THESE PERMITS AND FOLLOWS THROUGH ON THEM. <br />DISCUSSION CONTINUED, AND THE CHAIRMAN REQUESTED THAT ATTORNEY <br />BROWN DOUBLECHECK TO BE ABSOLUTELY POSITIVE THAT THIS IS THE PROCEDURE <br />THAT IS FOLLOWED IN THE ISSUING OF BUILDING PERMITS. <br />COMMISSIONER LOY NOTED THAT THE COMPLEXITY OF THE WORK THE <br />BOARD IS FACED WITH ALMOST ON A DAILY BASIS IS REQUIRING MORE AND MORE <br />CONSULTANTS. SHE FELT THE BOARD IS FAMILIAR WITH THE WORK SOUTHERN- <br />KELTON & ASSOCIATES HAVE DONE ON THE DUAL TAXATION AND FIRE STUDIES. <br />
