r <br />AUG 81979 <br />Basic <br />800E 41 PAGE 365 <br />3.2.3 If the Bidding or Negotiation Phase has not commenced <br />within three months after the Architect submits the Construction <br />Documents to the Owner, any Project budget or fixed limit of <br />Construction Cost shall be adjusted to reflect any change in <br />the general level of prices in the construction industry between <br />the date of submission of the Construction Documents to the <br />Owner and the date on which proposals are sought. <br />3.2.4 If a Project budget or fixed limit of Construction <br />Cost (adjusted as provided in Subparagraph 3.2.3) is exceeded <br />by the lowest bona fide bid or negotiated proposal, the Owner <br />shall (1) give written approval of an increase in such fixed <br />limit, (2) authorize rebidding or renegotiating of the Project <br />within a reasonable time, (3) if the Project is abandoned, <br />terminated or (4) cooperate in revising the Project scope and <br />quality as required to reduce the Construction Cost. <br />4.1 Period of Service. <br />4.1.1 The Architect will begin to work promptly after <br />receipt of a fully executed copy of this Agreement; such receipt <br />shall constitute written notice to proceed. <br />5.1 Method of Compensation. <br />5.1.1 Time Charges. The Owner agrees to compensate the <br />Architect for the professional services called for under this <br />Agreement by taking the direct salary expense of all those <br />persons engaged directly on the Owner's work and adding a <br />sur -charge of 187 per cent for overhead and profit for time <br />directly chargeable to the project. Average direct salary <br />expense shall not exceed the amounts shown on the following <br />schedule: <br />The first six principals <br />Project Manager, R. Singh <br />Department Heads <br />Architect or Engineer <br />Drafting <br />Clerkcal and Typing <br />5.1.2 Out -of -Pocket Expenses. The Owner shall reimburse the <br />Architect for all out-of-pocket expenses directly chargeable to <br />the project, at actual cost incurred, plus a service charge of <br />10 per cent. Such charges shall be itemized and included in the <br />monthly invoices for time charges and shall be submitted and <br />paid as provided for time charges. Typical reimbursable expenses <br />include travel, lodging, meals, and travel expenses when traveling <br />in the Owner's behalf, identifiable communication expenses, <br />identifiable reproduction costs, computer machine charges, survey <br />supplies, special accounting expenses not applicable to general <br />overhead. <br />i =1 <br />5.1.3 Limit of Fee. Total compensation. to the Ar��j.hitec.t �u 1.3 of <br />Professional services and costs described 'gAg9A*eJem <br />shall not exceed One Hundred Ninety-five Thousand and no/100 <br />Dollars ($195,000.00).
