L <br />ASSISTANT PLANNER DAVID MARSH NOTED THAT THE REQUEST IS FOR <br />ABANDONMENT OF THE SOUTHERN PART OF OLEANDER AVENUE BETWEEN POINSETTIA <br />BLVD. AND ORANGE STREET; IT DOES NOT COME DOWN AND TIE IN TO OLD DiXIE <br />HIGHWAY. <br />CHAIRMAN WODTKE DISCUSSED RETAINING A 15' EASEMENT, AND <br />ADMINISTRATOR JENNINGS STATED THAT HE'HAD FELT A 15' EASEMENT WOULD BE <br />MORE REALISTIC THAN A 10' ONE. MR. MARSH AGREED THAT IF THIS PORTION <br />IS ABANDONED, THE EASEMENT IS NEEDED FOR THE UTILITIES TO BE MAINTAINED. <br />ATTORNEY COLLINS INFORMED THE BOARD THAT IT APPEARED THERE <br />MAY BE A PROBLEM WITH THE LEGAL NOTICE. IT WAS ONLY PUBLISHED ONE TIME <br />AND THE STATUTE TALKS IN TERMS OF NOT LESS THAN TWO WEEKLY ISSUES OF <br />SAID PAPER, OR A REQUIREMENT OF TWO PUBLICATIONS. <br />ATTORNEY O'HAIRE, WHO IS REPRESENTING KEITH MARTIN, STATED <br />THAT HE WAS GOING UNDER THE REQUIREMENTS OF CHAPTER 336 WHICH REQUIRES <br />ONLY ONE PUBLICATION. <br />ATTORNEY COLLINS NOTED THAT THERE ARE TWO STATUTES THAT APPLY <br />TO ABANDONMENT OF STREETS IN THE STATE OF FLORIDA, AND HE HAD BEEN GOING <br />BY CHAPTER 177. CHAPTER 336 IS IN THE ROADS AND TRANSPORTATION AREA. <br />HE LEFT THE MEETING TO CHECK THE STATUTES AND STATED THAT THE BOARD <br />COULD PROCEED WITH THE HEARING IN THE MEANTIME. <br />CHAIRMAN WODTKE ASKED IF THERE IS ANY PROBLEM WITH TAKING THE <br />15' EASEMENT OFF THE NORTH SIDE, AND ATTORNEY O'HAIRE FELT THERE WAS NOT. <br />COMMISSIONER LOY ASKED HOW MANY PROPERTY OWNERS ARE INVOLVED, <br />AND ATTORNEY O'HAIRE STATED THAT THERE ARE THREE AND THEY HAVE ALL <br />CONSENTED TO THE VACATION. <br />ATTORNEY COLLINS RETURNED TO THE MEETING AND INFORMED THE <br />BOARD THAT THE AD IS IN ORDER AND THE STATUTE DOES FIT THE CIRCUMSTANCES. <br />THE BOARD REVIEWED A MAP OF THE PROPERTY IN QUESTION, AND <br />CONTINUED TO DISCUSS LOCATION OF AN EASEMENT. <br />ADMINISTRATOR JENNINGS STATED THAT A 10' EASEMENT DOESN'T <br />GIVE YOU ENOUGH LAND TO WORK ON AND HE WOULD RECOMMEND EITHER A 15' OR <br />20' EASEMENT HE NOTED THAT WHEN YOU ABANDON A ROAD, HALF OF THE <br />PROPERTY GOES TO `THE ADJACENT OWNERS, SO IF YOU TAKE A 20' EASEMENT OFF <br />THE WEST SIDE, IT HURTS ONE MORE THAN THE OTHERS. <br />AUG 81979 BOOK 41,1 FAu, <br />. 23 -- <br />
